Welcome to the BC Colleges website (the “Site”). By using the Site, you agree to follow and be bound by the following terms and conditions concerning your use of the Site (“Terms of Use”) and our Privacy Policy. We may revise the Terms of Use and Privacy Policy at any time without notice to you.

Although BC Colleges has taken due care to ensure that the material included on this site is accurate, BC Colleges cannot warrant that the information contained on this site is complete, does not contain typographical or other errors, or will meet specific requirements. As such, BC Colleges does not assume and hereby disclaims all liability, consequential or otherwise, for any loss or damage to any person or entity which is caused by or relates to errors or omissions on this site (including any supplementary information), whether such errors or omissions result from negligence, accident or any other cause.

1. Use of Materials

The copyright in all material provided on this Site is held by BC Colleges or by the original creator of the material. Except as stated herein, none of the material may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, without the prior written permission of BC Colleges or the copyright owner.

You also may not, without BC Colleges’ permission, “mirror” any material contained on this Site on any other server. Any unauthorized use of any material contained on this Site may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.

2. Public Communication

“Public Communication” means a discussion group, chat area, bulletin board, news group, letter to BC Colleges, its webmaster or employees, or e-mail function offered as part of the Site. You agree not to upload, email, post, publish or otherwise transmit through a Forum any content that is unlawful, threatening, libelous, defamatory, obscene, pornographic, or other material that would violate any law.

Forums shall be used in a noncommercial manner only. You shall not distribute or otherwise publish any content containing a solicitation of funds, promotion, advertising, solicitation for goods or services, or other commercial matter. You agree not to solicit other users of the Site to use or join or become members of any commercial online or offline service or other organization and you agree not to collect or store personal data about other users.

BC Colleges may, but is not obligated to, monitor or review any areas on the Site where users transmit or post Communications or communicate solely with each other, including but not limited to chat rooms, bulletin boards or other user forums, and the content of any such Communications. BC Colleges, however, will have no liability related to the content of any such Communications, whether or not arising under the laws of copyright, libel, privacy, obscenity, or otherwise. BC Colleges retains the right to remove messages that include any material BC Colleges deems abusive, defamatory, obscene or otherwise unacceptable.

3. Third Party Web Sites, Content, Products and Services

The Site provides links to Web sites and access to content, products and services from third parties, including users, advertisers, affiliates and sponsors of the Site. You agree that BC Colleges is not responsible for the availability of, and content provided on, third party Web sites. If you choose to purchase any products or services from a third party, your relationship is directly with the third party. You agree that BC Colleges is not responsible for: (a) the quality of third party products or services; and (b) fulfilling any of the terms of your agreement with the seller, including delivery of products or services and warranty obligations related to purchased products or services. You agree that BC Colleges is not responsible for any loss or damage of any sort you may incur from dealing with any third party.

4. Indemnity

You agree to defend, indemnify and hold harmless BC Colleges, its officers, directors, employees and agents from and against any and all claims, liabilities, damages, losses or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of the Site.

5. Applicable Laws

All matters relating to your access to, and use of, the Site shall be governed by the laws of British Columbia, Canada. You and BC Colleges agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.
